Terms of Service

These Terms of Service (“Terms”) govern your use of the Trails End Tavern website, online reservation services and optional SMS program, operated by Tupper Bar LLC, doing business as Trails End Tavern (“we,” “us,” or “our”). By using these services, you agree to the applicable Terms. Participation in the SMS program requires separate consent.

Please read these Terms and our Privacy Policy. The SMS dispute-resolution provisions below include individual arbitration, a class-action waiver and an opportunity to opt out of arbitration.

Our website provides restaurant information, a contact form and online reservations. Use accurate contact details and make reservations only for yourself or a party you are authorized to represent. You are responsible for reviewing your selected date, time and party size before submitting.

A reservation is confirmed when the booking service displays confirmation. An unavailable, delayed or undelivered email or text does not, by itself, cancel a confirmed booking. A waitlist entry is not a confirmed reservation.

Use your private reservation link to view or cancel an eligible reservation. For changes to the date, time or party size, larger parties or other requests, contact info@trailsendadk.com. Special requests are subject to availability and confirmation by the tavern.

We aim to keep menus, hours and availability accurate, but they may change. Online availability can change before a booking is completed. Website content does not guarantee the availability of a particular item, table or service.

The Trails End Tavern SMS program sends transactional reservation confirmations, one pre-arrival reminder and cancellation notices to guests who opt in. Reservation consent is not used to send promotional texts.

By selecting the optional, initially unchecked SMS consent box on our reservation form, you expressly consent to automated reservation text messages from Trails End Tavern at the number you provide. You confirm that you own or are authorized to use that number and can consent to messages sent to it.

Providing a phone number without selecting the SMS consent box does not enroll you. Consent is not a condition of a reservation or purchase. We retain a record of your consent and the notice presented when you opt in.

Your reservation confirmation text identifies the tavern and includes help and opt-out information. You must be at least 18, or the age of majority where you live if higher, to enroll in the SMS program.

Messages depend on your booking activity. A reservation may generate a confirmation, one reminder before arrival and a cancellation notice if cancelled. Reservations made close to arrival may not receive a reminder. Message delivery and availability are not guaranteed.

Message and data rates may apply. Trails End Tavern does not charge an additional SMS subscription fee. Your carrier may charge for messages sent or received and for data used when opening a link. Consult your mobile plan for details.

Reply STOP to a reservation text to unsubscribe. Our toll-free messaging provider processes STOP requests and may send a final confirmation. You can also use the private link in a text to choose “Stop all Trails End texts to this number,” or email info@trailsendadk.com for assistance.

After your opt-out is processed, no further program messages will be sent unless you validly opt in again. A message already in transit may still arrive. Selecting a new booking checkbox does not automatically override a previous stop request.

There is no penalty for opting out. Stopping texts does not cancel your reservation, restrict your ability to book or change your relationship with the tavern.

Reply HELP for automated text-program assistance. STOP and HELP keywords are handled by our messaging provider. Ordinary replies are not monitored for reservation changes or customer-service conversations.

For booking changes, questions or help with your preferences, use the private reservation link or email info@trailsendadk.com. Do not rely on a text reply to communicate an urgent change.

SMS availability depends on your carrier, device and location. Carrier support can change, and not all devices or networks support every feature. We do not guarantee that every message will be delivered or arrive at a particular time.

Mobile carriers are not liable for delayed or undelivered messages. Carriers may block or filter messages, change support for messaging programs and apply their own terms and charges. Service interruptions, network outages and technical issues may delay or prevent delivery.

• Provide accurate information and a valid mobile number you own or are authorized to use.
• Tell us if your number changes, or opt out before transferring it to another person.
• Keep private reservation links and personal information secure.
• Use the website and messaging program lawfully and treat our staff respectfully.
• Do not enroll another person in texts without their consent, make fraudulent reservations, interfere with security or opt-out controls, or use automated systems to abuse our services.

The website’s branding, photography, illustrations, text and design belong to Tupper Bar LLC or their respective owners and licensors. You may use the website for personal, lawful purposes. Other use of protected content requires permission unless allowed by law.

Links to maps and other third-party services are provided for convenience. We do not control those services; their own terms and privacy policies apply.

Our Privacy Policy explains how we handle website, reservation and communication information. We do not sell or rent mobile numbers, and we do not share mobile information or SMS consent data with third parties or affiliates for their own marketing or promotional purposes.

Service providers and telecommunications carriers process information as necessary to deliver requested messages and honor opt-outs, as described in that policy.

We may modify, suspend or discontinue website features or the SMS program. We may suspend access for misuse, invalid or blocked contact information, security concerns, or carrier and legal requirements.

We may update these Terms and will identify the current version by its effective date. Material changes will receive additional notice where appropriate or required. Changes to these Terms do not create consent to a different SMS purpose or override an opt-out; separate consent will be requested where required.

SMS service availability

To the fullest extent permitted by law, the SMS program is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement.

SMS liability limitations

To the fullest extent permitted by law, Tupper Bar LLC is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the SMS program, including carrier charges, lost revenue or opportunities, delayed or undelivered messages, or service interruptions.

Our total liability related to the SMS program will not exceed $100 or the amount you paid for products or services related to the SMS program, whichever is greater. These limitations do not exclude liability or consumer rights that cannot lawfully be excluded.

Informal resolution

Before filing a claim about the SMS program, contact info@trailsendadk.com so we can try to resolve the dispute informally.

Individual arbitration

Subject to applicable law and the exceptions below, disputes arising from the SMS program or its terms will be resolved through binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules rather than in court.

Disputes will be resolved on an individual basis. You and Tupper Bar LLC waive participation in a class action or class-wide arbitration to the extent permitted by law.

Opt-out and exceptions

You may opt out of arbitration within 30 days of accepting the SMS terms by emailing info@trailsendadk.com with your request. Small claims court actions and requests for injunctive relief are excluded from this arbitration provision. Nothing here limits rights that applicable law makes non-waivable.

Governing law. These Terms are governed by applicable United States federal law and the laws of New York, without regard to conflict-of-law rules, subject to mandatory protections that apply to you.

Severability. If a provision is held invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.

Entire agreement. These Terms and the Privacy Policy constitute the agreement concerning the website, reservation service and SMS program addressed here.

No waiver. Failure to enforce a provision does not waive our right to enforce it later.
